Terms of Service: Cristallo

These Terms of Service (the “Terms”) govern the use of the Cristallo website (the “Site”), as well as the relationship between visitors or users and the service provider. By using the Site, you are deemed to have read and accepted these Terms.

2. Purpose of the Site and general information

The Site provides information about our offer, presents products and services, lets you send inquiries and, where available, place orders (depending on the Site's features).

Cristallo strives to keep the information on the Site accurate and up to date, but does not guarantee that all content is complete, accurate or error-free at all times.

3. Indicative prices and how the final price is set (recommended)

Prices shown on the Site may be indicative. For products and services that are made to measure or depend on conditions on site, the final price is set after agreement, precise measurement and assessment of the installation or fabrication conditions on site, or based on accurate information provided by the customer.

Cristallo reserves the right to adjust the price if the input parameters change (measurements, choice of hardware or materials, installation complexity, site accessibility and the like), with prior notice.

4. Inquiries, quotes and orders

By sending an inquiry through the Site, by phone or by email, the user provides the information needed to respond and prepare a quote.
A quote (if provided) is valid for the period stated in it; if no period is stated, it is valid for a reasonable time given the nature of the work and market conditions.
A contractual relationship is formed only once Cristallo confirms the order or job (in writing or in another unambiguous way).

Cristallo may decline an inquiry or order in justified cases (for example, inability to deliver, lack of capacity, technical infeasibility and the like).

5. Fabrication, delivery and installation times

Fabrication, delivery and installation times depend on the type of product or service, material availability and the arrangement with the customer. Times stated on the Site or in communication are estimates, unless a fixed deadline has been expressly agreed.

In the event of force majeure or circumstances beyond our control (for example, supplier delays, weather conditions, emergencies), times may change, and Cristallo will notify the customer.

6. Payment

Payment methods and schedule (advance payment, payment in stages, payment on completion) are set by agreement or in the quote or invoice. If an external payment processor is used, payment is processed by a third party in accordance with its own rules.

7. Complaints, conformity and warranty

Cristallo handles complaints in accordance with the applicable regulations of the Republic of Serbia and the nature of the specific relationship (sale, made-to-measure fabrication or service).

For products made to measure, it is important that the customer confirms the specification (measurements, models, glass types, hardware and the like) before fabrication. Changes made after fabrication has started may affect the price and timelines.

8. Intellectual property rights and prohibition of unauthorized use

All original content of the Cristallo website, including but not limited to texts, photographs, video materials, graphics, illustrations, logos, visual identity, original product and model names, product and service descriptions, advertising messages, slogans, the structure and layout of content, the selection and arrangement of elements, the look of the user interface, design solutions, databases, documentation and other original elements of the Site, is a copyrighted work and/or the subject of other intellectual property rights.

This content is the property of ANDRIJA JEVTIĆ PR RADNJA ZA IZRADU PREDMETA OD STAKLA CRISTALLO NIŠ and/or its authors, rights holders and authorized licensors, unless expressly stated otherwise for specific content. All copyright, moral, economic and other intellectual property rights are reserved in full.

Without the prior express written consent of the rights holder, the following is expressly prohibited:

copying, downloading, photographing, recording, reproducing or duplicating the content, in whole or in part;
modifying, adapting, reworking, translating or creating derivative content;
publishing, distributing, selling, assigning, publicly displaying, publicly communicating or making the content available to third parties;
using the content on other websites, online stores, social networks, ads, catalogs, presentations, marketing materials or other digital and physical media;
using the content to promote or conduct competing or other commercial activities;
copying or imitating the look of the Site, its structure, navigation, layout of elements, wording, model names, product presentation or overall user experience;
automated collection of content, “scraping”, “crawling”, “mirroring”, cloning the Site, bulk downloading of data or using the content to develop or train automated systems;
removing or altering authorship marks, logos, watermarks, metadata, copyright notices or other indications of the origin of the content;
presenting Cristallo's content, photographs, work, references or design solutions as one's own or as the content of another person.

The prohibition also applies to the use of only part of the content, as well as to content that has been modified, adapted or combined with other elements, if the characteristic elements of the original content of the Cristallo Site are still recognizable in it.

Accessing the Site, viewing content, linking to the Site or purchasing products does not transfer copyright or other intellectual property rights, nor does it grant a license to use the content. Any permission must be given in advance, in writing, and applies only to the manner, scope, purpose and period of use expressly stated in the permission.

Any unauthorized use of the content will be considered an infringement of copyright and/or other intellectual property rights. Cristallo and other rights holders reserve the right, without prior notice, to demand the immediate removal of content, the cessation and prohibition of further use, the prevention of repeated infringement, compensation for material and non-material damages, publication of the court decision, as well as other legal remedies before the competent courts, government authorities, hosting providers, domain registries, search engines, social networks, advertising platforms and other intermediaries.

9. User conduct

The following is prohibited:

using the Site contrary to the law and good practice,
attempting unauthorized access to systems, accounts or data,
introducing malicious code or disrupting the operation of the Site,
providing false information for the purpose of deception or misuse.

Cristallo may restrict access to the Site in the event of misuse.

10. Links to third-party websites

The Site may contain links to external websites. Cristallo is not responsible for the content, security or privacy policies of those websites.

11. Disclaimer

Cristallo is not liable for:

damage resulting from interruptions of the Site, technical errors, viruses or unauthorized actions of third parties, to the extent permitted by law,
decisions made by users based solely on information from the Site, without prior verification and agreement,
differences between how products appear on screen and how they actually look (depending on device settings and materials).

Nothing in these Terms excludes liability that cannot be excluded or limited by law.

12. Personal data protection

The processing of personal data is governed by the Privacy Policy, published on the Site.

13. Governing law and dispute resolution

These Terms are governed by the law of the Republic of Serbia. Any disputes will be resolved amicably, and if that is not possible, the court with subject-matter jurisdiction at the service provider's registered seat will have jurisdiction, unless mandatory regulations provide otherwise.

14. Changes to the Terms

Cristallo reserves the right to change these Terms. Changes take effect from the moment they are published on the Site, and the last updated date is revised accordingly.
